1. Introduction
These Terms and Conditions ("Terms") govern your access to and use of the Kaskr platform ("Platform", "Service"), operated by Kaskr Ltd, a company registered in England and Wales (Company Number: 17072705) ("we", "us", "our").
By creating an account or using the Platform, you agree to be bound by these Terms. If you do not agree, you must not use the Service.
2. About the Service
Kaskr is a brewery management software platform designed for craft breweries. The Platform provides tools for batch management, inventory tracking, vessel management, compliance recording, and other brewery operations as described on our website at kaskr.com.
3. Eligibility
You must be at least 18 years old and have the legal authority to enter into these Terms. If you are using the Platform on behalf of a business, you represent that you have the authority to bind that business to these Terms.
4. Account Registration
To use the Platform, you must create an account by providing accurate, current, and complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must notify us immediately at privacy@kaskr.com if you become aware of any unauthorised use of your account.
5. Subscription Plans and Pricing
5.1 Plans
The Platform is offered across multiple subscription tiers, each with defined features and usage limits. Current plans and pricing are published at kaskr.com. We reserve the right to modify pricing with 30 days' written notice.
5.2 Free Trial
New accounts receive a free trial period. No credit card is required to start a trial. At the end of the trial period, you must subscribe to a paid plan to continue using the Platform.
5.3 Billing
All payments are processed by Paddle.com Market Limited ("Paddle"), who acts as the Merchant of Record for all transactions. Paddle handles billing, payment processing, tax compliance, invoicing, and refunds on our behalf. By subscribing, you also agree to Paddle's terms of service.
Subscriptions are billed monthly. Annual billing may be available on request and, where agreed, is billed upfront for the full year.
5.4 Cancellation
You may cancel your subscription at any time through your account settings. Upon cancellation, your account will remain active until the end of your current billing period. No refunds will be issued for partial billing periods.
6. Your Data
6.1 Ownership
You retain full ownership of all data you input into the Platform ("Your Data"), including but not limited to recipes, batch records, inventory data, customer information, and compliance records.
6.2 Licence to Us
You grant us a limited, non-exclusive licence to use, store, and process Your Data solely to the extent necessary to provide, maintain, and improve the Service.
6.3 Data Portability
You may export Your Data at any time using the tools provided within the Platform.
6.4 Data on Termination
Upon termination or cancellation of your account, we will retain Your Data for a period of 30 days, during which you may request an export. After this period, Your Data will be permanently deleted from our systems.
7. Acceptable Use
You agree not to:
- Use the Platform for any unlawful purpose or in violation of any applicable laws or regulations.
- Attempt to gain unauthorised access to any part of the Platform, other accounts, or any systems or networks connected to the Platform.
- Interfere with or disrupt the integrity or performance of the Platform.
- Reverse engineer, decompile, or disassemble any part of the Platform.
- Use the Platform to store or transmit any malicious code.
- Resell, sublicence, or provide access to the Platform to third parties without our written consent.
- Use automated means (bots, scrapers, etc.) to access the Platform without our written permission.
8. Intellectual Property
8.1 Our IP
The Platform, including its design, features, code, documentation, branding, and all related intellectual property, is owned by Kaskr Ltd. Nothing in these Terms transfers any intellectual property rights to you.
8.2 Feedback
If you provide feedback, suggestions, or ideas regarding the Platform, you grant us an unrestricted, perpetual, royalty-free licence to use such feedback for any purpose without obligation to you.
9. Service Availability
We aim to provide a reliable, high-availability service but do not guarantee uninterrupted access. The Platform may be temporarily unavailable due to scheduled maintenance, updates, or circumstances beyond our reasonable control. We will endeavour to provide advance notice of planned downtime where possible.
10. Limitation of Liability
10.1 Service Provided "As Is"
The Platform is provided on an "as is" and "as available" basis. To the fullest extent permitted by law, we disclaim all warranties, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.
10.2 Liability Cap
To the maximum extent permitted by applicable law, our total aggregate liability to you for any claims arising from or relating to the Service shall not exceed the total fees paid by you in the 12 months preceding the claim.
10.3 Exclusions
We shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, business, or goodwill, regardless of whether we were advised of the possibility of such damages.
10.4 Brewing Operations
The Platform is a management tool and does not replace professional judgement in brewing operations. You are solely responsible for the quality, safety, and regulatory compliance of your products. We accept no liability for any outcomes relating to your brewing processes, products, or operations.
11. Indemnification
You agree to indemnify and hold harmless Kaskr Ltd, its directors, employees, and agents from and against any claims, damages, losses, liabilities, and expenses (including legal fees) arising from your use of the Platform, your breach of these Terms, or your violation of any applicable law.
12. Modifications to the Service
We reserve the right to modify, suspend, or discontinue any part of the Platform at any time. We will provide reasonable notice of any material changes that significantly affect your use of the Service.
13. Changes to These Terms
We may update these Terms from time to time. We will notify you of material changes by email or through the Platform. Your continued use of the Service after such changes constitutes acceptance of the updated Terms. If you do not agree with any changes, you must stop using the Service and cancel your subscription.
14. Termination
We may suspend or terminate your access to the Platform immediately if you breach these Terms, fail to pay applicable fees, or engage in conduct that we reasonably determine to be harmful to the Platform, other users, or our business.
15. Governing Law and Disputes
These Terms shall be governed by and construed in accordance with the laws of England and Wales. Any disputes arising from or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of England and Wales.
16. Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall continue in full force and effect.
17. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Kaskr Ltd regarding the use of the Platform and supersede all prior agreements and understandings.
